李悝制《法经》,商鞅以之相秦,改法为律;萧何以秦《法经》为基础,增事律三篇而成《九章律》;魏晋修律以《九章律》为蓝本,增加篇目成《新律》及《泰始律》。这一古代律典沿革的谱系并非真实存在,而应是刘邵等律学家与臧荣绪、魏收及唐修《晋书·刑法志》众史官层累地制造出来的。他们之所以制造此谱系,当是受魏晋南北朝时期儒、道、释诸家制造“道统”“释统”之风影响所致,是有意为之的历史书写,不能以信史待之。

Abstract:
The law of Fa Jing ( 《法经》 ) was enacted by Li Kui, then Shang Yang made the Code of Qin in the foundation of it when he was prime minister of Qin state. Xiao He enacted the Code of Nine Chapters ( 《九章律 》 ) by adding three articles to the law of Fa Jing in beginning of Westen Han Dynasty. During the period of Wei and Westen Jin Dynasty, both the Code of Wei and the Code of Taishi were made by adding articles to The Code of Nine Chapters taken as the blueprint of legislaion. In fact, the genealogy of the evolution of the ancient legal code mentioned above is not real, but was fabricated by Liu Shao、Zang Rong Xu、Wei Shou and the historians who writen the Jin Shu Criminal Law Annals in Tang Dynasty. As for the reason why they fabricated this genealogy, it may attribute to the influence of Confucianism, Taoism and Buddhism in the Wei, Jin and Southern and Northern Dynasties. It was a deliberate historical writing, which could not be treated with faith in history.
